USEFUL INFORMATION FOR HIRING EZEQUIEL SCAGNETTI’S SERVICES
PHOTOGRAPHY LICENSING OPTIONS
Ezequiel Scagnetti offers five different image licensing packages.
The principle is simple: the broader the usage rights required, the higher the licensing fee. It is therefore in your interest to consider how the photographs will be used and to select only the rights you actually need.
1 – Corporate In-House Licence
This licence is intended for clients who are the final users of the photographs.
It includes:
Use of the photographs for all internal corporate communications.
Use on the company’s own websites and social media channels.
Use in company newsletters.
Use in the company’s own printed and digital educational, informational or promotional materials, including presentations, video presentations, annual reports, brochures, trade-show displays and similar materials.
A licence term of seven years.
This licence does not include:
— Distribution of the photographs to the media or as part of press/PR materials.
— Paid advertising.
— Transfer, resale or licensing of the photographs to third parties.
For example, the client may not provide a photograph to a magazine or other publication for use in an article. If a publication wishes to use one of the photographs, either the client or the publication must obtain the appropriate licence directly from Ezequiel Scagnetti.
Paid advertising includes any use for which advertising space or media placement is purchased, including newspapers, magazines, online platforms, television, billboards, public transport advertising and similar media.
If these uses are required, an additional licensing fee must be agreed on a case-by-case basis, or the client may choose one of the broader licensing packages below.
2 – Standard Corporate Licence
This package includes all the rights granted under the Corporate In-House Licence (#1), plus:
Use and distribution of the photographs for media relations, press releases and PR purposes.
The client may therefore provide the photographs to journalists, publications and media organisations in connection with its own communications and PR activities.
— Paid advertising is not included under this licence.
3 – Royalty-Free Corporate Licence
This package includes all the rights granted under the Standard Corporate Licence (#2), with no seven-year limitation.
The photographs may be used for the permitted purposes in perpetuity.
— Paid advertising is not included under this licence.
4 – Full Royalty-Free Licence
This package includes all the rights granted under the Royalty-Free Corporate Licence (#3) and additionally permits the photographs to be used for paid advertising and promotional purposes, in perpetuity.
5 – Full Copyright Buyout
A full copyright buyout involves the transfer to the client of the photographer’s transferable economic rights in the selected photographs, to the extent permitted by applicable law.
Following such a transfer, Ezequiel Scagnetti retains no economic ownership rights in the photographs covered by the agreement, except for any rights that cannot legally be assigned or waived.
The precise scope and conditions of any copyright transfer must be expressly agreed in writing.
APPLICABLE TO ALL LICENSING PACKAGES
Ezequiel Scagnetti and any photographer working under his direction retain their moral rights, to the extent provided for by applicable law.
Unless otherwise agreed in writing, Ezequiel Scagnetti may use photographs produced as part of an assignment for his own professional and promotional purposes, including portfolios, websites, social media, printed materials, books, exhibitions and other promotional media.
This right does not apply where the photographs contain confidential, sensitive or proprietary information, or where confidentiality has been expressly agreed with the client.
